Post Fiancée Visa For Uk

Hi all, i am a national of Trinidad and Tobago. An i met my boyfriend online in mid August of last year (2010). He is a national of England. I went out to see him in October of last year till, till the 10th of march this year. Which was just under the Six Months that i could of stayed on my Tourist Visa. Then he came out here in May for two weeks.

We get along great, and we are extremely fond of each other. An we are planning on getting married. However we both were previously married. After i decided that he was my Soul-mate i applied for a Divorce after coming back to TT i applied for a divorce and it was granted. I should be getting the Decree in a couple days. Him on the other hand has started his process.

My question is, when we are to apply for a Fiancée visa for myself. Would we automatically have a hard time, as we are both "FRESH DIVORCEES".

Also i am planning on going their in December of this year 2011, for a 3 week visit, during the holiday period. Can i go back on a tourist visa? As i spent just about 6 months on my first stay? How does the Uk border control check the "Calender Year" From time of entry and departure or January to December?
