Switzerland Visas, Permits and Immigration

European Union nationals who are residents of Switzerland are not normally required a visa for purposes of business and tourism. Citizens and legal immigrants of 25 European Union countries are free to enter Switzerland. The maximum length of stay by these EU nationals is 90 days or 3 months. Any form of work including voluntary and paid work is not permitted within the Swiss jurisdiction when the EU national travels with a European identification card or passport. 

Swiss Visa

Listed below are foreign nationals still required to apply and acquire a visa.

Residence permit holders such as:

•    Consular, special cards, diplomatic, etc.
•    Attestation d'immatriculation or Registration attestation in orange

Travel document holders issued by the country of residence including:

•    In a dark shade of blue – 1954 Convention de Geneva
•    In red
•    In grey – for steles persons

Foreign nationals exempted from acquiring a visa are the following:

•    Certificate of Inscription in Alien Register holders – This is also known as “Certificat D'Inscription Au Registre Des Etrangers” or CIRE. This is in a white-grey colored paper that is folded in 3 ways. This measures 225 millimeters by 120 millimeters. This document is valid if the initial legitimacy is at least a year or after it has been extended to another year.
•    The Identity or ID card for Aliens – This is also called “Carte D'Identité D'Etrangers”. The color of this document is yellow and folded in one portion only. It measures 124 millimeters by 88 millimeters.
•    Travel Document – This is also called “Titre De Voyage De Couleur Bleu Foncé”. Its color is in a darker shade of blue, which originated from the 1951 Geneva Convention.

Travel documents or passports must be legit for at least 5 months following the departure date from this country, while residence permits must be legit for the entire length of living in Switzerland. The foreign national must present both the residence permit and passport at the airport or nearest border. The process of acquiring visas will be at least 24 hours.

Nationals of Schengen member countries Switzerland allows visa-free access are required to present a national passport and stamps from any of the following countries:

•    Qatar
•    Kuwait
•    Bahrain
•    Saudi Arabia
•    United Arab Emirates
•    Thailand
•    Taiwan

Nationals of the countries above need to present service, diplomatic, special, and ordinary passports. Taiwanese nationals are only allowed to show ordinary passports.

Requirements for Business, Visitor, and Tourist Visas

The Swiss Consulate or Embassy will review visa applications submitted by foreign nationals. Applicants must contact the Swiss Consulate or Embassy in their own country or in a neighboring country if they do not have one in their homeland.

Incomplete visa applications are immediately rejected. This means it is best to complete the necessary requirements before filing the application.

Foreign nationals should submit visa application forms together with the needed documents at least 2 weeks before departure. Here is a list of requirements for a Swiss visa application:

a.    2 copies of recent and undamaged passport-sized pictures;
b.    travel documents or passport valid for at least 4 months following the entire length of stay in Switzerland;
c.    a residence permit valid after the end date of the stay;
d.    Schengen visa for 2 entries when the applicant has an orange card or Attestation D'immatriculation; and
e.    proof or evidence of adequate funding to cover all expenses within the applicant’s entire stay (proof can be in the form of credit card statements, traveler’s check, savings book, and most recent bank statements).

The minimum daily requirement for a foreign national to live in Switzerland is 70 Euros.

Additional requirements for Swiss tourist visa applications include:

a.    flat, holiday house or hotel reservation affixed with a complete address;
b.    children under 18 years old traveling in a school field trip need parental authorization legalized by the country’s competent commune;
c.    return airline tickets or transit tickets with confirmation from the travel agent; and
d.    students going on a field trip need a letter from the college, school, or university stating the participation of the applicant in the trip with the address and dates in Switzerland.

Additional Requirements for Swiss Business Visa Applications

a.    Applicants must provide an evidence of living business connections – this may be a letter from a business partner or company in Switzerland.
b.    The letter above must be sent to the Swiss Embassy or Consulate by fax.

Additional Requirements for Swiss Visitor’s Visa Applications

a.    An invitation letter from a Swiss resident confirming all expenses of the applicants during their length of stay in Switzerland will be covered by the host.
b.    The application letter must contain a complete address together with a photocopy of a Swiss passport, resident card or ID card in Switzerland and must be sent to the Swiss Embassy by fax.
c.    Declaration of assurance from the Cantonal Police of Aliens if necessary.

Requirement for Swiss Transit Visas
 
A transit visa allows holders to go through Switzerland for 24 hours without getting out of the vehicle. The only requirement for a transit visa is a transit or travel ticket.

Transit visas at the Airport

Airport transit visas allow holders to stay in the airport for more than 48 hours. Passport holders and citizens of countries such as Angola, Afghanistan, Bangladesh, Ethiopia, Democratic Republic of Congo, Ghana, India, Guinea, Lebanon, Iran, Pakistan, Nigeria, Sri-Lanka, Sierra Leone and turkey require a transit visa. If they hold a visa or residence permit for a European country, Norway, Canada, Iceland or United States or service or special passport, they are not required a transit visa.  

Switzerland Labor or Work Permit

The Switzerland immigration government has a dual system for the admission of foreign workers. Gainfully working nationals from the EFTA and European states can benefit from agreements on the free movement of persons. Only a limited number of management level specialists, employees and other qualified employees are admitted from all other countries. Not all nationals may get a labor or work permit. Rather, only skilled individuals are accepted.

Three Circle Policies

Switzerland has presented legal measures because of falsified closer links with the EU or European Union. Immigrants find it more difficult to enter Switzerland with these legal measures. The method of geographical and cultural discrimination initially known as the “three circle policy” was issued in the year 1998 by an admissions system that makes a difference between European Free Trade Association members and European Union members.

Swiss Immigration Policy

The Federal Government decided that German citizens with German passports who are not Aryan according to the German law might enter any Swiss border crossing. They can enter Switzerland only if they have a confirmed permission to stay in Switzerland or a confirmed permission of transit through Switzerland.

Immigration Program for Swiss Investors

The Swiss immigration program for investors is a bit different from other immigration programs. Some wealthy persons choose Switzerland as their immigration destination for the “lump sum” because the financial income of a family member is free from taxes. When foreign nationals are younger than 55 years, they are not fit to apply in the usual residence permit to retire in Switzerland. A difference of this program is that they may get the same residence permit by investing in a Swiss local company. The characteristics of this investment are listed below.
 
•    Foreign nationals invest in a company in the area where they want to reside.
•    The investments of foreign nationals must be enough to finance the development of the company.
•    Foreign nationals may invest as equity or as a loan or a combination of both.
•    The investment of foreign nationals must last as long as you remain in Switzerland.
•    The company cannot be listed on a stock exchange.
•    Foreign nationals cannot invest in a bank account or an apartment company.

This program allows foreign nationals to invest in a Switzerland-based company in need of financing. This also  generates jobs in Switzerland.

Swiss Immigration

The bilateral agreement between Switzerland and Europe on free movement of persons came into effect in 2002. This agreement gives the European Union national to geographical and occupational mobility in Switzerland and the equality of social security and work conditions. They were also given the right to be joined by their families who can engage in gainful service in Switzerland and mutual recognition of diplomas with a view to employment.  The agreement also essentially adopts the categories of residence permits while they exist within the European Union. The categories are listed below.

•    B permits – these are annual residence permits, which means employment agreement must be a 1-year contract;
•    L permits - for those foreign nationals with less than 1 year employment, and this is also known as short-term residence permit;
•    C permits – this permit is usually granted after 5 years of residency, and this is also known as a settlement permit; and
•    G permits – this permit is also known as cross border commuter permit.
